PODAVACH Minimum Advertised Price (MAP) Policy

Purpose
At PODAVACH Inc., we are dedicated to maintaining high profit margins for our authorized resellers. Our Minimum Advertised Price (MAP) Policy ensures that all resellers, whether dealers or bulk customers, can advertise our products while preserving the value of our brand and the investment made in customer service and product knowledge.

By purchasing our products for resale, you agree to comply with this MAP Policy.

General Guidelines

  • The MAP pricing for all PODAVACH products is listed in the current price list. All advertised prices must meet or exceed the MAP set by PODAVACH Inc.
  • While resellers are not required to display prices, if prices are mentioned, they must adhere to the MAP.
  • Acceptable advertising phrases include “call for price” or “call for quote.”

Compliance

  • Resellers must ensure that all advertising, including on internet search engines, adheres to the MAP.
  • The MAP applies to all advertising mediums, including:
    • Print ads (magazines, newspapers, etc.)
    • Broadcast (radio, TV)
    • Direct mail
    • Internet placements (websites, emails, etc.)

Prohibited Practices The following actions are considered violations of this MAP Policy:

  • Advertising with a price below the MAP, including rebates or incentives that effectively lower the advertised price.
  • Offering free products or discounts that result in a reduced advertised price.
  • Any alterations to the displayed MAP, such as strike-throughs or automated price quotations that show prices below MAP.

Permitted Practices

  • Resellers may advertise that they offer the lowest prices or will match competitors.
  • Personal price quotes may be provided in response to direct customer inquiries.

MAP Holidays

Certain days are designated as MAP holidays where the MAP Policy does not apply:

  • Veterans Day
  • Independence Day
  • Black Friday
  • Cyber Monday

Compliance and Enforcement

Failure to comply with the MAP Policy may result in the loss of Authorized Reseller status. PODAVACH Inc. will implement the following corrective actions for violations:

  • First Violation: Temporary account hold and written warning; issues must be resolved within 24 hours.
  • Second Violation: Account hold for 30 days.
  • Third Violation: Account hold for 180 days, subject to review for reinstatement.
  • Fourth Violation: Indefinite removal of Authorized Reseller status.

Agreement Confirmation

By proceeding with a purchase for resale, you confirm that you have read, understood, and agreed to abide by the PODAVACH MAP Policy.
